By accessing https://www.myaskai.com, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by My AskAI.

We, My AskAI, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  1. modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
  2. remove any copyright or other proprietary notations from any materials and software on this website;
  3. transfer the materials to another person or “mirror” the materials on any other server;
  4. knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service My AskAI provides;
  5. use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
  6. use this website or its associated services in violation of any applicable laws or regulations;
  7. use this website in conjunction with sending unauthorised advertising or spam;
  8. harvest, collect or gather user data without the user’s consent; or
  9. use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Money-Back Guarantee

If, after your 30-day free trial, you move onto the Pro monthly plan and your AI agent doesn’t resolve at least 50% of your support tickets in its first paid month, we’ll give you that month’s subscription fee back.
1. Who can claim – only customers on the Pro monthly plan during their first paid month after the free trial.   2. What counts as “AI resolution” – a ticket counts as resolved when the AI replies to the customer in Direct Reply mode and it is not handed to a human agent.   3. Minimum usage – you must have had 500 or more conversations or tickets handled by the AI agent in Direct Reply mode during the month.   4. Calls with us – you must complete      1. an onboarding call before or during your trial and      2. an off-boarding call within 14 days after the first paid month so we can review the results together   5. How to claim – cancel your subscription and email support@myaskai.com within 14 days of the end of that first paid month. We’ll verify the figures and, if the conditions above are met, refund 100% of that month’s Pro-plan fee to your original payment method within 14 days.   6. One-time only – the guarantee can be used once per organisation and doesn’t apply to add-ons or later billing periods.   7. Your statutory rights – this guarantee is in addition to, and doesn’t affect, any rights you have under law.

Intellectual Property

The intellectual property in the materials contained in this website are owned by or licensed to My AskAI and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by My AskAI at any time.

Confidential Information & Data-Retention Definition of Confidential Information “Confidential Information” means all non-public data or materials disclosed or made available by either party that 1. Are marked or otherwise identified as confidential or   2. A reasonable person would understand to be confidential given the nature of the information and the circumstances of disclosure. It includes, without limitation, Customer Content, personal data, trade secrets, business plans, financial information, and technical know-how. It does not include information that 1. Is or becomes public through no breach   2. Was lawfully known by the receiving party before disclosure   3. Is independently developed without use of the disclosing party’s Confidential Information   4. Is rightfully received from a third party without confidentiality obligations. Identification & Designation Each party will designate Confidential Information at the time of disclosure by: 1. Affixing a proprietary or “confidential” legend to tangible materials;   2. Identifying oral disclosures as confidential at the time of disclosure and confirming in writing within ten (10) days; or   3. Using secure technical means (e.g., encrypted file-transfer portals) that clearly label files as confidential. The receiving party will treat all such information as Confidential Information whether or not it is perfectly marked, provided the receiving party knew or reasonably should have known it was confidential. Retention Period & Destruction AskAI shall retain Customer Confidential Information only for as long as necessary to: 1. Perform the Services or   2. Comply with applicable law or the Customer’s written instructions, whichever is longer (the “Retention Period”). Upon the earlier of: 1. Customer’s written request or   2. Thirty (30) days after the Retention Period ends, AskAI will securely destroy or, at Customer’s option, return all Confidential Information and certify deletion. Confidential data will be protected against unauthorised access during the entire Retention Period. Exceptions AskAI may retain minimal back-up copies automatically generated by its disaster-recovery systems for up to thirty (30) additional days, provided such copies remain inaccessible in normal business operations and are purged on the next scheduled back-up cycle. Evidence & Audit Upon reasonable notice (and no more than once annually), Customers may review AskAI’s retention-and-destruction logs maintained to verify compliance with this section, subject to reasonable time, place, and confidentiality restrictions.


Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, My AskAI makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall My AskAI or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if My AskAI or an authorised representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
